3. Operating Engineer Responsibility & Change Control
The operating engineer, systems administrator, or database administrator accessing this site is solely responsible for:
- Securing complete, consistent pre-flight backups (including RMAN database backups, VM hypervisor snapshots, and LVM storage clones) prior to executing any commands.
- Validating all database parameter changes, SQL execution plan baseline pins, kernel tuning adjustments (`sysctl`), and operational scripts in an isolated non-production staging environment.
- Strictly adhering to their institution's organizational change-control policies, risk reviews, and maintenance window approval gates.
4. Express "AS IS" Warranty Disclaimer

- Paid Digital Assets & Runbooks: Licensed under a Commercial Single-Organization License for internal operational use within the purchasing institution only. Public distribution, resale, or sub-licensing is strictly prohibited.
8. Refund & Cancellation Policy
- Digital Runbooks & Downloadable Code: Due to the non-returnable nature of downloadable digital software and technical runbooks, all sales are final upon delivery/download.
- Health Audits & Advisory Services: Health audit bookings may be cancelled for a full refund up until diagnostic trace file analysis has commenced. Once diagnostic log processing begins, audit fees are non-refundable.
9. Governing Law, Jurisdiction & Dispute Resolution
These Terms of Service, their interpretation, and any disputes arising out of or related to your use of DBPros.Net shall be governed by and construed in accordance with the laws of the Republic of Trinidad and Tobago, without regard to its conflict of law principles. You agree that any legal action, claim, or proceeding shall be brought exclusively in the courts of competent jurisdiction located in Trinidad and Tobago. Any commercial dispute or claim arising out of or relating to these Terms or digital products may be submitted to binding arbitration in Port of Spain, Trinidad and Tobago at the election of either party under the Arbitration and Conciliation Act (Chap. 5:01).
International Consumer Note: Where mandatory statutory consumer protection laws apply by operation of mandatory law (such as within the European Union or United Kingdom), nothing in these Terms shall limit or diminish statutory consumer rights that cannot legally be waived by contract.
